Examine the data over time, and you'l find irrefutable evidence of progress: the decline of war and violent crime, the increase in life spans; the spread of literacy, democracy, and equal rights; the waning of privilege based on race, gender, heredity, beliefs (Jina Moore and a team of Monitor writers say this much more specifically in our cover story: "Progress Watch 2012").
Every so often there are vivid scenes of good news -- Neil Armstrong bouncing onto the moon, revelers atop the Berlin Wall, Nelson Mandela walking out of Robben Island prison. But most of the time good news is incremental, which causes it to be taken for granted.
Not bad news. When we hear it, we sit up and ask, "What just happened?" Bad news can make us beat our fists on the table and ask where was God and how can such a terrible thing happen. Bad news is mesmerizing. We can't look away from a collapsing high-rise or an inundated coastal town. We know the meaning of a sidewalk filled with flowers and teddy bears.
Bad news is insistent. In fairness, bad news isn't all bad. It can alert us to problems that need to be addressed. But in the grand scheme of things, there's actually not that much of it . Oh, there's always enough for a front page or a?Web bulletin or a nightly newscast, although sometimes reporters have to travel to the ends of the earth to find it. Bad news has a natural advantage, however. It pulses through humanity's central nervous system -- word of mouth, the media, the Internet. Its images are riveting and its stories are dramatic. It floods the zone.
And when there's a shortage of bad news in the present, we can always turn to the future. Welcome to worry, dread, and pessimism. Sure, things seem OK now, but just over the horizon a disaster is brewing. Don't be a sap. Bad things are on the way.
They probably are. And they'll shock us and again make us wonder if life is out of control. But in this last issue of our news magazine for 202, we're looking in the rearview mirror to see how things are going, and we're finding plenty of reason for hope.
Hope helps. It keeps us going in bleak times and amid disheartening news. But hope has much more credibility when we can point to the reason for it. Asserting that we should all cheer up is sweet. Knowing why is powerful.
Here are some reasons for hope: Extreme poverty is declining. HIV is no longer a death sentence. Technology is transforming everything from African agriculture to urban transportation. Drug violence is decreasing in Mexico. Travel is safer almost everywhere. Crime rates are falling. Somalia is emerging from a long night of anarchy. Myanmar (Burma) is coming out of its dictatorial shell. And while it's true that China and Russia are only semi-free and the Egypt and other post-dictator nations may be going down ill-considered paths, water is still carving the valley. Freedom lives in 7 billion hearts.
Bad news will make headlines in 2013. But good news will quietly rule.

FOUNTAIN, Colo. (AP) ? First Lt. Aaron Dunn deployed to the Afghanistan in early March 2012. His 4th Brigade Combat Team, 4th Infantry Division, was charged with engaging Taliban fighters in Kunar Province and mentoring Afghan government soldiers. Upon returning, here are some of his views.
Coming home:
"War and coming home are going to mean different things to each soldier. For me it was God and Family. I get my security in life from my hope in God, and my companionship and support from my family. I really didn't worry too much during deployment, because of that faith."
Support for those serving:
"For a lot of soldiers, it's the family back home that drives them. Support from family and friends is very important. Support is also important from the American public. Often times a simple thank you is enough."
The emotional toll:
"In my opinion, its tougher on the families, especially after the unit takes a casualty. I personally can't imagine waiting, not knowing if your loved one is alive or even alright, and having a panic each time a car drives by your drive way thinking it's the military chaplain and escort coming to see you."
Making up for the lost time with family:
"A lot of people seem to think that 'quality time' will make up for a long absence. It doesn't. Its 'quantity time' that does that. It is the time spent doing things that are fun, but also the time spent doing the daily chores, and other routines that firmly bring a family together. Emma was 5 months old when I deployed, and 14 months old when I returned. I was able to stay in touch with the family and had the luck to watch Emma begin to crawl via Skype."

WASHINGTON - Retired Gen. H. Norman Schwarzkopf, who topped an illustrious military career by commanding the U.S.-led international coalition that drove Saddam Hussein's forces out of Kuwait in 1991 but kept a low public profile in controversies over the second Gulf War against Iraq, has died. He was 78.
A sister of Schwarzkopf, Ruth Barenbaum of Middlebury, Vermont, said Thursday that he died in Tampa, Florida, from complications from pneumonia. "We're still in a state of shock," she said by phone. "This was a surprise to us all."
A much-decorated combat soldier in Vietnam, Schwarzkopf was known popularly as "Stormin' Norman" for a notoriously explosive temper.
He served in his last military assignment in Tampa as commander-in-chief of U.S. Central Command, the headquarters responsible for U.S. military and security concerns in nearly 20 countries from the eastern Mediterranean and Africa to Pakistan.
Schwarzkopf became "CINC-Centcom" in 1988 and when Saddam Hussein invaded Kuwait three years later to punish it for allegedly stealing Iraqi oil reserves, he commanded Operation Desert Storm, the coalition of some 30 countries organized by President George H.W. Bush that succeeded in driving the Iraqis out.
"Gen. Norm Schwarzkopf, to me, epitomized the 'duty, service, country' creed that has defended our freedom and seen this great nation through our most trying international crises," Bush said in a statement. "More than that, he was a good and decent man ? and a dear friend."
At the peak of his postwar national celebrity, Schwarzkopf ? a self-proclaimed political independent ? rejected suggestions that he run for office, and remained far more private than other generals, although he did serve briefly as a military commentator for NBC.
While focused primarily in his later years on charitable enterprises, he campaigned for President George W. Bush in 2000 but was ambivalent about the 2003 invasion of Iraq, saying he doubted victory would be as easy as the White House and Pentagon predicted. In early 2003 he told the Washington Post the outcome was an unknown:
"What is postwar Iraq going to look like, with the Kurds and the Sunnis and the Shiites? That's a huge question, to my mind. It really should be part of the overall campaign plan," he said.
Initially Schwarzkopf had endorsed the invasion, saying he was convinced that former Secretary of State Colin Powell had given the United Nations powerful evidence of Iraqi weapons of mass destruction. After that proved false, he said decisions to go to war should depend on what U.N. weapons inspectors found.
He seldom spoke up during the conflict, but in late 2004, he sharply criticized then-Defence Secretary Donald Rumsfeld and the Pentagon for mistakes that included inadequate training for Army reservists sent to Iraq and for erroneous judgments about Iraq.
"In the final analysis I think we are behind schedule. ... I don't think we counted on it turning into jihad (holy war)," he said in an NBC interview.
Schwarzkopf was born Aug. 24, 1934, in Trenton, New Jersey, where his father, Col. H. Norman Schwarzkopf Jr., founder and commander of the New Jersey State Police, was then leading the investigation of the Lindbergh kidnap case, which ended with the arrest and 1936 execution of German-born carpenter Richard Hauptmann for stealing and murdering the famed aviator's infant son.
The elder Schwarzkopf was named Herbert, but when the son was asked what his "H'' stood for, he would reply, "H." Although reputed to be short-tempered with aides and subordinates, he was a friendly, talkative and even jovial figure who didn't like "Stormin' Norman" and preferred to be known as "the Bear," a sobriquet given him by troops.
He also was outspoken at times, including when he described Gen. William Westmoreland, the U.S. commander in Vietnam, as "a horse's ass" in an Associated Press interview.
As a teenager Norman accompanied his father to Iran, where the elder Schwarzkopf trained the country's national police force and was an adviser to Reza Pahlavi, the young Shah of Iran.
Young Norman studied there and in Switzerland, Germany and Italy, then followed in his father's footsteps to West Point, graduating in 1956 with an engineering degree. After stints in the U.S. and abroad, he earned a master's degree in engineering at the University of Southern California and later taught missile engineering at West Point.
In 1966 he volunteered for Vietnam and served two tours, first as a U.S. adviser to South Vietnamese paratroops and later as a battalion commander in the U.S. Army's Americal Division. He earned three Silver Stars for valour ? including one for saving troops from a minefield ? plus a Bronze Star, a Purple Heart and three Distinguished Service Medals.
While many career officers left military service embittered by Vietnam, Schwarzkopf was among those who opted to stay and help rebuild the tattered Army into a potent, modernized all-volunteer force.
After Saddam invaded Kuwait in August 1990, Schwarzkopf played a key diplomatic role by helping to persuade Saudi Arabia's King Fahd to allow U.S. and other foreign troops to deploy on Saudi territory as a staging area for the war to come.
On Jan. 17, 1991, a five-month buildup called Desert Shield became Operation Desert Storm as allied aircraft attacked Iraqi bases and Baghdad government facilities. The six-week aerial campaign climaxed with a massive ground offensive on Feb. 24-28, routing the Iraqis from Kuwait in 100 hours before U.S. officials called a halt.
Schwarzkopf said afterward he agreed with Bush's decision to stop the war rather than drive to Baghdad to capture Saddam, as his mission had been only to oust the Iraqis from Kuwait.
But in a desert tent meeting with vanquished Iraqi generals, he allowed a key concession on Iraq's use of helicopters, which later backfired by enabling Saddam to crack down more easily on rebellious Shiites and Kurds.
While he later avoided the public second-guessing by academics and think-tank experts over the ambiguous outcome of Gulf War I and its impact on Gulf War II, he told The Washington Post in 2003, "You can't help but... with 20/20 hindsight, go back and say, 'Look, had we done something different, we probably wouldn't be facing what we are facing today.'"
After retiring from the Army in 1992, Schwarzkopf wrote a bestselling autobiography, "It Doesn't Take A Hero." Of his Gulf war role, he said, "I like to say I'm not a hero. I was lucky enough to lead a very successful war." He was knighted by Queen Elizabeth II and honoured with decorations from France, Britain, Belgium, Kuwait, Saudi Arabia, United Arab Emirates, Qatar and Bahrain.
Schwarzkopf was a national spokesman for prostate cancer awareness and for Recovery of the Grizzly Bear, served on the Nature Conservancy board of governors and was active in various charities for chronically ill children.
"I may have made my reputation as a general in the Army and I'm very proud of that," he once told the AP. "But I've always felt that I was more than one-dimensional. I'd like to think I'm a caring human being. ... It's nice to feel that you have a purpose."
Schwarzkopf and his wife, Brenda, had three children: Cynthia, Jessica and Christian.

China unveiled tighter Internet controls on Friday, legalizing the deletion of posts or pages which are deemed to contain "illegal" information and requiring service providers to hand over such information to the authorities for punishment.
The rules signal that the new leadership headed by Communist Party chief Xi Jinping will continue muzzling the often scathing, raucous online chatter in a country where the Internet offers a rare opportunity for debate.
The new regulations, announced by the official Xinhua news agency, also require Internet users to register with their real names when signing up with network providers, though, in reality, this already happens.
Chinese authorities and Internet companies such as Sina Corp have long since closely monitored and censored what people say online, but the government has now put measures such as deleting posts into law.
"Service providers are required to instantly stop the transmission of illegal information once it is spotted and take relevant measures, including removing the information and saving records, before reporting to supervisory authorities," the rules state.
The restrictions follow a series of corruption scandals amongst lower-level officials exposed by Internet users, something the government has said it is trying to encourage.
Li Fei, deputy head of parliament's legislative affairs committee, said the new rules did not mean people needed to worry about being unable to report corruption online. But he added a warning too.
"When people exercise their rights, including the right to use the Internet, they must do so in accordance with the law and constitution, and not harm the legal rights of the state, society ... or other citizens," he told a news conference.
Chinese Internet users already cope with extensive censorship measures, especially over politically sensitive topics like human rights and elite politics, and popular foreign sites Facebook, Twitter and Google-owned YouTube are blocked.
Earlier this year, the government began forcing users of Sina's wildly successful Weibo microblogging platform to register their real names.
The new rules were quickly condemned by some Weibo users.
"So now they are getting Weibo to help in keeping records and reporting it to authorities. Is this the freedom of expression we are promised in the constitution?" complained one user.
"We should resolutely oppose such a covert means to interfere with Internet freedom," wrote another.
The government says tighter monitoring of the Internet is needed to prevent people making malicious and anonymous accusations online, disseminating pornography and spreading panic with unfounded rumors, pointing out that many other countries already have such rules.
Despite periodic calls for political reform, the party has shown no sign of loosening its grip on power and brooks no dissent to its authority.

I truly believe there are two reasons for that: I have an amazing team with really talented professionals who are doing what they?re meant to do and our overhead went from thousands of dollars a month to almost nothing.

OTTAWA (Reuters) - A Canadian aboriginal chief in the third week of a hunger strike is urging Prime Minister Stephen Harper to "open his heart" and meet with native leaders angered by his policies as small impromptu protests spread beyond Canada's borders.
Chief Theresa Spence from the remote northern Ontario community of Attawapiskat has been fasting since December 11 and has vowed to continue until Harper personally commits to the talks on a litany of complaints, including new legislation that she says will harm native lands.
"He's a person with a heart but he needs to open his heart. I'm sure he has faith in the Creator himself and for him to delay this, it's very disrespectful, I feel, to not even meet with us," she said in an interview in Ottawa.
Spence is at the center of an unprecedented Canadian aboriginal protest movement called "Idle No More" that began with four women in the province of Saskatchewan raising awareness about the Conservative government's budget bill, which was passed earlier this month.
The bill, which has also been heavily criticized by opposition politicians for its broad reach, scales back environmental protections for lakes and rivers and makes it easier to sell reserve lands.
Aided by Facebook and Twitter, their protest proliferated faster than anyone had imagined and is now drawing comparisons to the "Occupy Wall Street" movement.
"Flash mob" protests with traditional dancing and drumming have erupted in dozens of shopping malls across North America. There have been rallies, marches and highway blockades by aboriginal groups across Canada and supporters have emerged from as far away as New Zealand and the Middle East.
The campaign aims to draw attention to the dismal living conditions faced by many of the country's 1.2 million natives, including poverty, unsafe drinking water, inadequate housing, addiction and high suicide rates.
'I'M WILLING TO DIE'
Camped out in a traditional teepee within sight of Ottawa's Parliament buildings, Spence appeared weak and short of breath but resolute on Thursday, Day 17 of her hunger strike, staying warm by a wood stove as a snow storm raged outside.
To critics who question her strategy and say her demands are too vague, Spence replies that she has run out of patience.
"I know it's hard for people to understand what I'm doing but it's for this pain that's been going on too long with our people," she said, sitting on her makeshift bed and flanked by supporters.
Blankets hung from the inside walls of the teepee and a faint aroma of cedar rose from branches spread on the ground. Spence is consuming only water, fish broth and a medicinal tea.
"It has to stop and I'm willing to suffer until the meeting goes on. Even if I don't make it, people will continue my journey. Like I keep saying, I'm willing to die for the people of First Nations because the suffering is too much," Spence said.
Spence was in the headlines last year when a severe housing crisis in her community forced people to live in tents in temperatures of minus 40 Fahrenheit (minus 40 Celsius).
The Canadian government suggested taxpayer funds were being squandered and appointed an outside adviser to oversee the town's finances, a move seen as insensitive and later rejected by the courts.
Harper met with native leaders in January but Spence says he had his own agenda and that this time the aboriginal leaders want to bring their issues to the table.
"Why are they so afraid to meet with us?" she said.
Harper's office declined to comment. A spokesman for Aboriginal Affairs Minister John Duncan said the minister has tried repeatedly to reach Chief Spence with no success.
"We will continue trying to engage the chief and other First Nation leaders to discuss how we can build on the progress we have made since 2006," said the spokesman, Jason MacDonald.
MacDonald said Ottawa had built and renovated schools and homes, invested in safe drinking water, introduced legislation to protect the rights of women on reserves and settled over 80 land claims.
Harper also formally apologized in 2008 on behalf of Canada for having in the past forced 150,000 aboriginal children into residential schools, where many were abused.
SIMILAR TO 'OCCUPY' MOVEMENT?
Meanwhile, with the help of social media the Idle No More movement has taken on a life of its own in much the same way the first "Occupy Wall Street" camp gave birth to a multitude of "occupy" protests with no specific demand or leadership.
Events listed on the group's Web site for Friday include rallies in Los Angeles and London, where protesters plan to present Queen Elizabeth with a letter.
But organizers say they've lost track. Their initial Facebook page has 33,000 members and the Twitter hash tag was mentioned 40,000 times in a single day at its peak on December 21.
"This has spread in ways that we wouldn't even have imagined," said Sheelah McLean, an instructor at the University of Saskatchewan who was one of the four women who originally coined the "Idle No More" slogan.
"I don't think the hash tag is the most important thing that has happened," she said.
"What this movement is supposed to do is build consciousness about the inequalities so that everyone is outraged about what is happening here in Canada. Every Canadian should be outraged."

SAN FRANCISCO (Reuters) - Yahoo Inc rolled out new versions of its popular Web email on Tuesday, the first major product makeover since Chief Executive Marissa Mayer took the helm of the struggling Internet company five months ago.
Yahoo released new versions of its Yahoo Mail product for smartphones and tablets - in keeping with Mayer's focus on mobile devices - and a revamped version of its Web-based mail product for PC users that cuts out ancillary features and that the company said delivers faster performance.
"You've told us loud and clear that you want fewer distractions when it comes to email. You want to quickly login, communicate, and get on with your day," Mayer said in a post on Yahoo's official blog on Tuesday.
Yahoo is the No. 1 Web email product in the United States and No. 3 worldwide, behind Google Inc's Gmail and Microsoft Corp's Hotmail, according to comScore.
But the number of unique users of Yahoo email declined 16 percent in November from a year earlier in the United States and 7 percent worldwide in October, according to comScore. Gmail's unique users increased 25 percent in the U.S. in November and 20 percent worldwide in October.
Analysts say Yahoo's email decline also owes partly to the broader trend of younger Internet users who prefer to communicate with text messages rather than email.
Mayer, 37, is moving to revitalize Yahoo's various Web products and reverse years of declining revenue. A former Google executive, Mayer is widely admired in Silicon Valley for her Web product savvy, though some analysts and investors have expressed caution, noting that Mayer has never before led an entire company as CEO.
She has said her top priority is to create a coherent mobile strategy for Yahoo and that she intends for at least half of the company's technical workforce to be working on mobile products.
As part of Tuesday's announcement, Yahoo unveiled an update to its mobile email app for smartphones based on the Android operating system, as well as Yahoo's first stand-alone app for Apple's iPhone.
Yahoo also released a version designed for tablets and PCs based on Microsoft's new Windows 8 operating system.
Vivek Sharma, General Manager of Yahoo Mail & Messenger, said the group of new mobile apps was part of Yahoo's goal of ensuring that its products are available across all major mobile platforms -- a move that he said should help Yahoo's email stay popular with the younger generation of users.
"Most of the new users, especially young ones, are using mobile Internet devices. So the first order of things is to make sure there are native experiences for them," said Sharma referring to mobile apps that are specially designed for smartphones.
FEWER ADS
The new PC version of Yahoo Mail features fewer ads, primarily by doing away with pass-through Web pages that users previously encountered before they could access their inbox and which appeared after a user sent an email.
Eliminating those pages, and improvements to the way Yahoo displays its email Web pages, means that users can now reach their inboxes 40 percent faster, Sharma told Reuters in an interview on Tuesday.
Yahoo's email product is an important piece of Yahoo's overall online business, serving as a conduit to bring in users which Yahoo then tries to redirect to its other websites, such as news articles, stock quotes and videos.
By simplifying the product's look, Yahoo could increase the amount of time that users spend visiting its online properties, said RBC Capital Markets analyst Andre Sequin.
"A website can be incredibly useful, but if a user interface is annoying or has too many flashing ads, it can drive a person away," said Sequin.
He compared Yahoo's email revamp to one of the key accomplishments that Mayer is credited with at Google: the sparse homepage, which is free of ads and prominently features a search engine box surrounded by white space.
"Improve the experience on mail and there's a good chance you can get people to stay engaged with Yahoo properties for a long time," said Sequin.
Shares of Yahoo were up 11 cents to $19.54 in midday trading on Tuesday.
Yahoo's stock has risen 25 percent since Mayer became CEO in July, reaching its highest level since September 2008 when Yahoo co-founder Jerry Yang was CEO.
The years between Yang and Mayer were tumultuous ones at Yahoo, as the Web pioneer cycled through four different chief executives and a variety of strategies.
Yahoo ranks among the world's most popular websites, with roughly 700 million monthly visitors. But revenue has eroded due to competition from Google and Facebook and changes in the online advertising market that have compressed prices for the online display ads that are key to Yahoo's business.
Many analysts and tech-industry observers say Yahoo's online products have failed to keep up with rivals when it comes to integrating innovative mobile and social media features.

WASHINGTON (AP) ? The United States could see its standing as a superpower eroded and Asian economies will outstrip those of North America and Europe combined by 2030, according to the best guess of the U.S. intelligence community in its latest forecast.
"The spectacular rise of Asian economies is dramatically altering ... U.S. influence," said Christopher Kojm, chairman of the National Intelligence Council, as it released the report Global Trends 2030 on Monday.
The report is the intelligence community's analysis of where current trends will take the world in the next 15 to 20 years. Its release was timed for the start of a new presidential administration and it is aimed at helping U.S. policymakers plan for the future.
The report also predicted the U.S. will be energy independent.
The study said that in a best-case scenario, Americans, together with nearly two-thirds of the world's population, will be middle class, mostly living in cities, connected by advanced technology, protected by advanced health care and linked by countries that work together, perhaps with the United States and China cooperating to lead the way.
Violent acts of terrorism will also be less frequent as the U.S. drawdown in troops from Iraq and Afghanistan robs extremist ideologies of a rallying cry to spur attacks. But that will likely be replaced by acts like cyber-terrorism, wreaking havoc on an economy with a keystroke, the study's authors say.
In countries where there are declining birth rates and an aging population like the U.S., economic growth may slow.
"Aging countries will face an uphill battle in maintaining living standards," Kojm said. "So too will China, because its median age will be higher than the U.S. by 2030."
The rising populations of disenfranchised youth in places like Nigeria and Pakistan may lead to conflict over water and food, with "nearly half of the world's population ... experiencing severe water stress," the report said. Africa and the Middle East will be most at risk, but China and India are also vulnerable.
That instability could lead to conflict and contribute to global economic collapse, especially if combined with rapid climate change that could make it harder for governments to feed global populations, the authors warn.
That's the grimmest among the "Potential Worlds" the report sketches for 2030. Under the heading "Stalled Engines," in the "most plausible worst-case scenario, the risks of interstate conflict increase," the report said. "The U.S. draws inward and globalization stalls."
"This is not inevitable," said lead study author Mathew Burrows. "In most cases, it's manageable if you take measures ... now."
Such steps could include decreasing wasting resources like water and increasing the efficiency of food production, he said.
Technology is seen as a potential savior to head off some of this conflict, boosting economic productivity to keep pockets filled despite rising populations, rapid growth of cities and climate change.
Hand in hand with technology is cooperation between the competing states, the authors say. In the most plausible best-case outcome, the report said, "China and the U.S. collaborate," heading off global competition for resources that can lead to all-out conflict.
The report warns of the mostly catastrophic effects of possible "Black Swans," extraordinary events that can change the course of history. These include a severe pandemic that could kill millions in a matter of months and more rapid climate change that could make it hard to feed the world's population.
Two positive events are also listed, including "a democratic China or a reformed Iran," which could bring more global stability.
One bright spot for the U.S. is energy independence.
"With shale gas, the U.S. will have sufficient natural gas to meet domestic needs and generate potential global exports for decades to come," the report said.

CARACAS (Reuters) - Venezuelan President Hugo Chavez said on Saturday he would undergo another cancer operation in the coming days after doctors in Cuba found a third recurrence of malignant cells in his pelvic area.

"Unfortunately, during these exhaustive exams they found some malignant cells in the same area ... . It is absolutely necessary, absolutely essential, that I have to undergo a new surgical intervention," the 58-year-old said, looking resolute.
"With God's will, like on the previous occasions, we will come out of this victorious."
The president has already had three cancer operations in Cuba since the middle of last year. News of more surgery will likely raise new doubts about his future and the fate of his self-styled "revolution" in the OPEC nation.
Chavez, who has dominated Venezuelan politics since taking power 14 years ago, said he would return to Havana on Sunday.
Under Venezuela's constitution, an election would have to be held within 30 days if Chavez were to leave office within the first four years of his next term, due to begin on January 10.
The president has been receiving treatment at the Cimeq hospital in Havana as a guest of his friend and political mentor, former Cuban leader Fidel Castro.

(Reuters) - Aetna Inc , the third-largest U.S. health insurer, has agreed to pay as much as $120 million to settle nationwide litigation over how it reimburses members for out-of-network medical services.
The accord calls for Aetna to pay $60 million into a general settlement fund, plus as much as $60 million more, depending on how many people submit claims.
Aetna said it will take a $78 million after-tax charge in the current quarter for the settlement, and that the charge will not affect operating earnings. It expects to pay for the settlement over the next one to two years.
Patients and doctors accused Aetna of using databases provided by Ingenix Inc, a unit of UnitedHealth Group Inc
The Hartford, Connecticut-based insurer was also challenged over how it calculated out-of-network reimbursement rates, and over its disclosures about those calculations.
"It continues to be a problem that insurers use improper bases to pay low reimbursement rates," said Joe Whatley, a lawyer for the out-of-network providers, in a phone interview. "We hope this settlement will deter similar conduct."
In a joint court filing on Friday, the plaintiffs and Aetna said the accord was "adequate, fair and reasonable."
It would cover patients who used out-of-network providers from March 1, 2001, to the present, and cover out-of-network providers from June 3, 2003, to the present. The litigation began in July 2007.
"We are pleased that we were able to reach a favorable agreement," James Cecchi, lead lawyer for the plaintiffs, said in a phone interview.
The settlement requires approval by U.S. District Judge Stanley Chesler in Newark, New Jersey. Aetna said it expects approval in the middle of 2013, and that it may void the settlement if too many people decide not to participate.
On January 13, 2009, UnitedHealth and Aetna agreed to stop using the Ingenix database and to help fund a new independent database to calculate rates, under agreements with then-New York attorney general, Andrew Cuomo, who is now the state's governor.
Two days later, UnitedHealth agreed to pay $350 million to settle lawsuits over its out-of-network reimbursements.
In early afternoon trading, Aetna shares were up 1.9 percent at $44.24 on the New York Stock Exchange.
